We inform that Bidroom BV entrusts the execution of some of the tasks related, among other things, to the collection, processing and protection of personal data to the subsidiary: BIDROOM POLAND sp. z o.o. with registered office at Aleja Zygmunta Krasińskiego 17/2, 31-111 Kraków, Tax Identification Number (NIP): 6762559536, National Business Registry Number (REGON): 382033220 entered into the National Court Register under number 0000762608, which, by cooperating closely with Bidroom BV, is a co-administrator of the databases in which your personal data is stored.
(“Bidroom”, “we”, or “us”,) are committed to protect and respect your privacy. We, also want you to understand that we need certain information to deliver you the best services and make your booking process run smoothly. Please make sure you know our privacy policy before you agree to our terms and conditions. We will notify you in the case of any changes in our privacy policy.
1. Scope of policy
1.1 This policy together with the General Terms of Service apply to your use of our website bidroom.com (the "Site")
1.2 This policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed and used by us.
1.3 Controller
We are the data controller responsible for your personal data.
1.4 Data Protection Officer
We have appointed Marcin Wesolowski as data protection officer ("DPO"). He has several important responsibilities, including:
monitoring Bidroom’s compliance with the GDPR and other data protection laws
raising awareness of data protection issues
training of Bidroom staff

In general, you should be aware that providing personal data over the internet or otherwise can never be guaranteed as being completely safe.
2. Cookies
2.1 We use cookies to distinguish you from other users of the Site. This helps us to provide you with a good experience when you use the Site and allows us to improve our Site.
2.2 Bidroom uses cookies and other technologies such as web beacons and pixel tags to help us improve your user experience when it comes to searching for hotels and booking your stay. Among other things, we use these cookies to save your preferences related to the use of our portal, remember when you are on our website and track your activity.
2.3 If you do not want to use cookies, you can personally change the settings in your Internet browser. Keep in mind, however, that we will not be able to provide you with the optimum service, if you disable cookies tracking.
3. Information we collect about you
3.1 We will collect and process data about you (Submitted information). This information is submitted by you in process of registration and activation of your Bidroom membership and includes categories of personal data such as:
User IP address
Name
Phone number
Encrypted information regarding your chosen password
Social media platforms IDs’ that can be used to log in
Avatar URL or image
3.2 Externally, secured services (for example Stripe) are responsible for storing your credit card details and billing address
3.3 We collect this information during the registration-, activation-, search- and booking process
4. Uses made of the information
4.1 Below is a summary of the key types of data that we make use of as part of the Bidroom service:

Social media platforms IDs’ that can be used to log in
Avatar URL or image
Credit card details and billing address (Stripe)
4.2 The above data is used to allow you to use your membership and search for and book accommodation. We always ensure that a lawful basis exists for all the personal data we process. Our processing of your personal data will be legitimized as follows: if the processing of your personal data is necessary for the performance of a contract between you and us or for taking any pre-contractual steps upon your request, such processing will be based on GDPR Article 6(1) lit. (b). If this personal data is not processed, we will not be able to execute the contract with you (e.g. your purchase of our services).
4.3 We pass your information only to hotels / accommodations during the process of reservation to make hotels / accommodations accept the reservation. In this reservation process the following data is provided to hotels / accommodation properties:
Name
Phone number
Credit card details for booking guarantee (stored in independent, secured servers)
5. Promotional offers from us
5.1 We may use your personal data (such as your Submitted Information or Location Information) to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which services, destinations or offers may be relevant for you.
5.2 You will receive marketing communications from us if you have signed up to and/or utilize the Bidroom membership and have expressly consented to receiving marketing communications from us.
5.3 We always ensure that a lawful basis exists for all the personal data we process. Our processing of your personal data will be legitimized as follows: where the processing is necessary for the purposes of our legitimate interests, such processing will be made in accordance with GDPR Article 6(1) lit. (f), for example to detect fraud or share information (such as on upcoming promotional offers) that we think may be of interest to you. Whenever we require your consent for the processing of your personal data such processing will be justified pursuant to Article 6(1) lit. (a) of the GDPR. This article in the GDPR describes when processing can be done lawfully. In addition, in some cases, the domestic law of the given country obliges us to process part of the data due to legal obligations, e.g. tax obligations or those related to state security, and in this event the basis for the processing is the Article 6(1) letter c.
5.4 We will obtain your express opt-in consent before we share your personal data with any company outside Bidroom for marketing or promotional purposes.
6. Opting out
You can ask us or third parties to stop sending you marketing messages at any time by adjusting your marketing preferences via 'Privacy' section found within the 'Profile' tab of the App or by following the unsubscribe links on any marketing message sent to you. Each marketing communication will contain an opt-out link or explanation how to opt-out from receiving marketing notifications.
7. Data processing partners
7.1 We will disclose the data we collect from you to certain third parties who use personal data in delivering their services to us (so-called data processors). They use data securely and confidentially and under strict contractual controls in accordance with data protection laws and enforced by Bidroom.
7.2 We send personal data to the following sets of data processors to perform booking / reservation processes on Bidroom such as:
Stripe: secured service to process credit cards
Channel managers: services responsible for sending bookings / reservations between Bidroom and particular hotels / accommodation providers
8. Storage, security & international transfers
8.1 The data that we collect from you will be transferred to, and stored at, a destination inside the European Economic Area (EEA). As we provide an international service your data may be processed outside of the EEA (related to the place of the international service) to perform your booking / reservation process using your Bidroom membership. We do not sell, exchange, transfer or disclose any non-public personal data about you to anyone, except as permitted or required by law or regulation and to our service providers who (i) require such information to provide such services and (ii) do not further sell, exchange, transfer or disclose such information. Such service providers are located in the UK and the EEA. We will ensure that transfers of personal data outside the EEA will take place in accordance with the relevant European privacy legislation (GDPR). In this respect we – for example – rely on the necessity of the transfer for the performance of the contract (article 49 subparagraph sub b GDPR) or by using standard data protection clauses (article 46 subparagraph 2 GDPR). We will take all steps to ensure that your data is treated in accordance with the GDPR and in accordance with this privacy policy.
8.2 All information you provide to us is stored on our secure servers. Any payment transactions carried out during booking / reservation process, will be encrypted using Secured Sockets Layer technology or a secure virtual private network.
8.3 We retain personal data about you for as long as necessary to perform the activities described in this privacy policy, or where we have an ongoing legitimate business need to do so, such as for legal, regulatory, accounting or reporting requirements. When our legitimate interest for retaining your personal data ceases to exist, we will either delete or anonymize your personal data so that it can no longer be attributed to an individual. To the extent residual personal data remains within our databases, back-ups or other records and we are unable to anonymize it we will isolate such information from further processing until deletion is possible.
8.4 Your personal data and your activity on the Bidroom.com website may be partially used for profiling or making automated decisions only for marketing purposes in order to attempt to tailor the Bidroom's offer to your needs.
9. Your legal rights
You have rights under data protection laws in relation to your personal data. Please see below to find out more about these rights.
You have the right to:
9.1 Request access to your personal data (commonly known as a "data subject access request").
This enables you to receive a copy of the personal data we hold about you. If you require this, then please reach out to us via: DPO@bidroom.com
9.2 Request correction of the personal data that we hold about you.
This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us. If you require this, then please reach out to us via: DPO@bidroom.com
9.3 Request erasure of your personal data.
This enables you to ask us to delete or remove personal data where there is no legitimate reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law.
Note, however, that we may not always be able to comply with your request of erasure for specific legal or practical reasons which will be notified to you, if applicable, at the time of your request.
9.4 How to request erasure of personal data.
In order to request erasure of your personal data via website, please follow the steps below:

- Access “profile” section.
- At the bottom of this page, find and click the button to deactivate an account
- Confirm the action of account deactivation
- You will be automatically logged out from your deleted account, and your data will be permanently deleted from our system.
To remove the account via Bidroom Mobile Application follow these steps:
- Make sure you have no active bookings or booking requests. To cancel your active bookings and requests

- Open section: “Account & Password settings”
- Choose action “Delete Account” at the top of the screen
- Confirm the action of account deactivation
- You will be automatically logged out from your deleted account, and your data will be permanently deleted from our system.
9.4 Request the transfer of your personal data to you or to a third party
We will provide to you your personal data in a structured, commonly used, machine-readable format, which you can then transfer to an applicable third party. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you. 9.5 Withdraw consent at any time where we are relying on consent to process your personal data.
However, this will not affect the lawfulness of any processing carried out before you withdraw your consent (or of course where your consent is not the legal basis for our processing of your personal data). If you withdraw your consent, we may not be able to provide the Bidroom services and membership to you. We will advise you if this is the case at the time you withdraw your consent.
9.6 What we may need from you?
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.
9.7 Time limit to respond
We try to respond to all legitimate requests within two weeks. Occasionally it may take us longer if your request is particularly complex or you have made several requests. In this case, we will notify you and keep you updated.
9.8 What if you fail to provide personal data
Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (Bidroom membership). In this case, we may have to cancel your use of Bidroom and our service, but we will notify you if this is the case at the time.
10. Changes to privacy policy
10.1 Any changes we may make to our privacy policy in the future will be posted on this page and, where appropriate, notified to you by e-mail.

Please note that for the purposes of your safety and quality of our services, we update our Privacy Policy periodically, and that is why Bidroom BV reserves the right to change and modify this Policy, including adding new or deleting existing entries, which it may perform at its sole discretion at any time by submitting the amended Privacy Policy to the Service website. Therefore, the User is obliged to regularly check if the Privacy Policy has not been changed. If the User still uses the Service after the publication of changes and has not deactivated the account, it means that the changes have been accepted. Unless otherwise stated, the amended Privacy Policy shall automatically enter into force seven (7) days after being published on the Service website.
